Macy's Be Damned -- Martha Stewart & J.C. Penney Still Happening

In spite of a preliminary injunction from Macy's, Martha Stewart remains undaunted in her partnership with J.C. Penney.
Yesterday morning, Martha Stewart Living Omnimedia Inc. claimed that "nothing has changed" since being slapped in the legal briefs by Macy's earlier this month and is still planning on launching its line of Penney's products next year.
Of course, the $288 million deal -- an increase from $178 million -- might have something to do with it.
Stewart's contract with Macy's was set to expire in early 2013 at which point she would hop on over to Penney's, but Macy's performed the retail version of a cockblock and extended the domestic diva's contract another 5 years, making her deal with Penney's kind of illegal.
Then Macy's sued Martha and won the preliminary injunction, preventing Martha from hocking her goods in Penney's.
This case is primarily a contract dispute over how certain products are branded and sold, not about the validity of the partnership with J.C. Penney, MSLO CEO and president Lisa Gersh told WWD on Monday, noting that the judge's ruling earlier this month was in no way final.
No, that'll come after the trial in November, right on time for Thanksgiving. Hopefully Martha won't be on the other end of the carving knife. [WWD, sub req'd]
