Although there is already a state law requiring condom use, the AHF’s “Safer Sex In The Adult Film Industry Act” would provide additional enforcement. Placing the act on the ballot would cost $4.4 million and city officials are looking to clarify whether the law would actually be enforceable, or if it would be pre-empted by the state law.

In the meantime, the city has already received threats of lawsuit from the adult film industry with the Free Speech Coalition supporting the industry’s success in “preventing HIV infections through its testing protocols and self-regulation.” The  AHF insists, however, that the issue is a matter of public health and that the efforts of the adult film industry and the presence of the state law don’t provide enough…protection.
