“Fake goods aren’t totally bad, at least it created jobs at some counterfeit factories,” Bertelli said in a Bloomberg television interview on Thursday. “We don’t want to be a brand that nobody wants to copy.”

Such sentiment may come as a surprise from one of the top 10 most valuable luxury brands in the world, and unsurprisingly warranted some elaboration. A Prada spokesman used the oft-popular “taken out of context” excuse, telling WWD, “The quote is part of an extended conversation that underscored how the market of counterfeits is an objective reality for successful brands and how this phenomenon has its own reality, also in terms of manufacturing, that is very structured.”

- In a clear-cut case of “not letting shit go,” Gucci is now suing Guess in Italy, China and France. They’ll get that $221 million one way or another. [WWD, sub req'd]

Gucci filed suit in 2009, alleging that Guess and its footwear licensee Marc Fisher Footwear had used “studied imitations of Gucci trademarks” — including the block letter “G,” a combination of red-and-green stripes and diamond-logo motifs – and “knocked off” more than $200 million in product.

Judge Scheindlin found that Fisher’s use of the red-and-green stripes was identical to Gucci and therefore likely to cause “trademark dilution,” i.e. cheapen Gucci’s image. The judge, however, denied Gucci’s counterfeiting claims, stating “courts have uniformly restricted trademark counterfeiting claims to those situations where entire products have been copied stitch-for-stitch.”

Gucci was awarded $4.7 million in combined damages from Guess and Marc Fisher for their use of the Quatro G pattern. Gucci was also granted an injunction against Guess, barring them from using the Quatro G pattern, the green-red-green stripe and certain other square G marks.

Whether this ruling will have any bearing on the  trademark infringement case involving Christian Louboutin‘s red sole debacle with that other PPR brand Yves Saint Laurent is yet to be seen. But for Guess CEO, Paul Marciano, the Gucci v. Guess case should’ve been resolved by the two companies and not the court.

In a statement issued yesterday, Marciano hinted that the battle might not be over as Gucci is “currently court-forum shopping to find a friendly court but Guess will vigorously defend our rights in every jurisdiction.” [WWD, sub req'd]

Fisher’s lawyer, Darren Saunders, questioned Fisher over Gucci’s accusations that the defendants undertook a “massive scheme” to knock-off its designs, to which Fisher grew visibly choked up.

“I don’t understand the allegation,” his voice reportedly “quavering.” Accusations such as those, he insisted, would “jeopardize” not only his, but his family’s reputation.

“My family has been making shoes in this country probably longer than Guess exists,” he continued. Fisher’s father founded Nine West in 1978, while Fisher opened his own eponymous company in 2005.

During a three-hour cross-examination, Fisher repeatedly denied that his company knocked off Gucci’s shoes, but merely used them, and other brands, for “reference.”

“We do reference and use vintage designs quite a bit in our industry,” Fisher said, adding that sometimes shoe designs that were allegedly infringed upon Fisher had originally produced years before.

“So, Jimmy Choo knocked you off and then you knocked Jimmy Choo off?” Gucci lawyer Louis Ederer said sarcastically.

Fisher explained that many shoes turned out to be “tremendously similar” particularly over a “50-year period of time.”

Earlier that day, Ederer produced not only a thick binder from the Marc Fisher Footwear library, featuring five years of Gucci shoes Fisher Footwear had used for inspiration, but also a record of Fisher’s Gucci purchases over the last six to seven years, a total of $75,000.

The price tag seemed to shock Judge Shira Scheindlin who responded curiously, “I never saw a $2,000 pair of shoes. What do they look like?”

Ederer explained it was for a dress, not a pair of shoes — probably to the judge’s disappointment — before ending with his final question to Fisher: “You find this case ridiculous, don’t you Mr. Fisher?”

What is this, an episode of The Practice, or whatever legal show the kids are watching these days?

“I don’t think anything that takes this much time and money out of my life is ridiculous,” Fisher replied. “Gucci should have written me a [cease-and-desist] letter. That’s what should have happened.” [WWD, sub req'd]

- Marc Fisher, the CEO of Guess‘ footwear licensee grew so frustrated at the barrage of questions from Gucci‘s lawyer over the similarities between the shaded patterns over the two brand’s shoes he reportedly said, “I don’t understand why we’re spending 45 minutes discussing shading.” Ease up, Fisher. “This morning, at the courthouse, we saw the square G on a handbag,” Marciano, reportedly excited, told the court. He had taken a picture of the woman earlier with her permission, of course.

“It’s a counterfeit,” Louis Ederer, Gucci’s bulldog of lawyer countered.

“But we asked the lady,” Marciano said. “She said it was real.”

“Of course she told you that,” the judge said, chuckling, and the matter was dropped and the case adjourned till Monday.

Marciano had previously tried to prove that Givenchy had developed the square “G” before both Gucci and Guess, to no avail. If Guess loses this case, however, they might end up owing Gucci $221 million in damages as well as receive a permanent injunction to keep them from making and selling anything with the interlocking “G” design. Gucci claims Guess and its footwear licensee Marc Fisher Footwear has been knocking off its logo and designs for years and is seeking $221 million in damages. Louis Ederer, lawyer for the Italian luxury giant, barraged Marciano with questions and referenced emails dating back to 1995  between Guess buyers and Marc Fisher employees. He also brought up a history of cease and desist letters from Coach, Yves Saint Laurent, Jimmy Choo and Adidas claiming Marc Fisher was knocking off their designs.

Through it all Marciano insisted that Guess simply took inspiration from different brands, including Gucci, for its logos, patterns and designs. When Ederer brought up emails from Marc Fisher indicating that the company was sending Gucci fabric samples to Guess fabric suppliers, Marciano claimed he had no knowledge of the correspondence. However, upon seeing the similarities between Guess and Gucci sneakers, he was “embarrassed.”

Ederer blasted Guess for not following up with Marc Fisher about the shoes saying, “The truth is that Guess has been knocking off Gucci for years.” To which Marciano responded, “No…fashion is about trend, mood and inspiration. You interpret your own way with your own brand.”

To illustrate his point, Marciano referenced the courtroom’s carpeting and claimed that his design team would reinterpret it and throw it on a handbag, to some mild courtroom chuckling.

After Ederer finished badgering the witness, Guess’ lawyer Daniel Petrocelli took over, asking Marciano to describe the company’s relationship with Gucci. Marciano insisted they never had any problems till a cease and desist letter in 2007 and that “if this is something Gucci was genuinely concerned with, they would have acted within days, everywhere,” instead of twiddling their thumbs since 1995. - Gucci and Guess have finally taken their three-year copyright battle to court where Guess’ own lawyer routinely insults his client’s quality and lack of class: “Guess doesn’t slap a house name on a product, Guess screams its name, it surrounds you…Gucci uses leather, Guess uses plastic, that’s why it costs 100 bucks.” That kind of defense you can’t buy. CEO and creative director of Guess Paul Marciano chose Schiffer to front the 30th anniversary campaign based on the impact her original ad had on not only the company, but on pretty much everyone. “She was a turning point of Guess, she was a turning point of Ellen’s career, Guess was a turning point of a life for Claudia,” he told WWD.

The shot of Schiffer in a lace bustier, tussled tresses and gold hoops set the blueprint for all future Guess ads and according to Marciano, “made her career” and subsequently “made Guess a different company. Everybody talked about the Guess Girl.”

Schiffer, for her part, was happy to wax nostalgic with Marciano and Unwerth. “Guess will always have a soft spot in my heart, and I’m excited that 23 years later we can still work together so successfully,” the super said. Meanwhile, can we talk about how at 41 — which is 1002 in model years — Schiffer has aged nary a day? They just don’t make supermodels like they used to, i.e. in a lab somewhere in Switzerland.

The Guess 30th Anniversary Collection will include T-shirts bedazzled with images of Gost and Smith — sign me up for the latter, thanks — a sheer leopard-print blouse and the three-zipper Marilyn jeans that introduced the brand to the world. The Dinner & A Movie Date

This date is a classic one. It seems like going out for dinner and a movie is the type of date that had stood the test of the. If you’re smart you’ll do the movie before the dinner. (So you have at least something to discuss besides awkward small talk.) This is a semi casual date. you want to be relaxed but not too informal. A solid button up shirt and a pair of dark washed jeans create the perfect uniform. Try not to be too flashy and throw on an understated watch. Just because you’re wearing jeans does not mean it’s OK to wear your most raggedy tennis shoes. A pair of  smart and nondescript sneakers will work in lieu.

The Night On The Town Date

The Night On The Town Date is strictly reserved for the guys who are extremely cool and have contacts everywhere. They know where all the hottest restaurants and parties are and they are always invited to them. Everyone knows who you are so you’ll have to look fly when painting the town red with your date. Nothing says smooth like a sweet biker jacket and tee. Ditch the boring jeans and for for an interesting pair of trousers. A sleek pair of sneakers will help you stomp around the city comfortably while looking super cool at the same time. If you are the accessories type of guy then throw in of some statement jewelry like a necklace or bracelet.

The Sunday Mass Look:

Many of you are going to Sunday mass this Sunday because of your religious beliefs or in my case an overbearing yet loving mother who doesn’t want to see her oldest boy go to hell. (But I digress) When it comes to displaying personal style in religious situations one must put their ego aside to be respectful.  You can go or this seasons bright colors but don’t overdo it because the service is not about you no matter how bad you want it to be.

On the women’s end most of the pieces are very girly and reminiscent of decades past. I loved all of the nautical inspired pieces including the belts featured above.

They are keeping it cool for the warm weather on the guys end. I am currently in desperate need for boots and the GUESS Men’s boots featured above would make my year. I also gagged over several Gc Swiss Timepieces, GUESS’s higher end watches which is also featured above.

All T-shirt sales benefit  Sojourn Services for Battered Women & their Children which provides battered women and their children a safe space to regroup, rebuild, and reestablish their self-esteem and lives.

The GUESS store on Hollywood Blvd was lit up with stars this past Wednesday night for a T-shirt launch party. Guests included Andy Garcia, Dominik Garcia-Lorido, Holly Robinson Peete, Jessica Lowndes, Sasha Barrese, Alison Sweeney, Molly Burnett and Casey Deidrick, Danielle Fishel, T-Shirt Designer Ella Marciano, GUESS CEO & Vice-Chairman Paul Marciano, and special musical guest DJ Mathieu Schreyer.

They were all there to celebrate to the debut of a new line of GUESS charitable T-shirts designed to make a difference in honor of Domestic Violence Awareness Month, October. 100% of the net proceeds are going to benefit Santa Monica-based Sojourn Services for Battered Women and their Children. The T-shirt, only $24, features words of inspiration drafted by 16-year-old Ella Marciano – Hope, Love, Courage, Strength, Community and Empower are designed in the shape of a heart, the symbol of love, and the graphic is penned in purple, the universal color of Domestic Violence Awareness Month.

The ads were shot in Memphis, the birthplace of rock ‘n’ roll. The campaign story follows three rebels as they embark on a road trip to Memphis and try and make their mark in the music scene.

I am dying overs this campaign for many reasons. I love the fact that the pictures were shot in black and white, following the trend of other clothing companies who have done the same this fall. This kind of photography seems to make everything look more elegant somehow.  I also enjoy the styling of the models. The campaign looks so retro while still being up to date. Lastly, I love the direction that GUESS is going with their actual clothes. They have manged to keep their classic rock edge, but are very relevant to today’s fashion needs.

If you aren’t familiar with the brand, the background of it lies within the vintage California lifestyle. It is also the newest of the Guess brand, created back in 2007. It is a youthful and fresh line of clothing designed for the next generation of young, hip, fashionable men and women. To top it all of most of the products retail for under $100 and the fall collection will be available just in time for back in school shopping.  They will hit the online store before retail shops so that is your best bet for now and while you are there; check out Guess’s new site.

GUESS by Marciano is  a line designed for women, young and old, who want to look great without breaking the bank.  AnnaLynne McCord, Eliza Dushku, and Tinsley Mortimar are all fans of the line.

This  specific collection is full of gorgeous pieces including mixes of denim and leather, bold prints, and great accessories.  Here are a few of my favorite things from the collection. My favorite Spanish male model (because he’s gorgeous and I met him in Valencia0) is the new face of Guess. Any excuse that gets him out of clothes and onto a sandy beach is fine with me!

Tinsley Mortimer has quickly become my new obsession. After meeting her at the Guess by Marciano/Susan G. Komen event last week, I’ve been Goggle, Twitter and Facebook stalking the social who has been a staple of the New York scene for quite a long time.

With a reality show hitting the tube soon, it’ll only be a matter of time before this Manhattan gem, becomes a mainstream megastar so it’s nice to see her dressed for the party in head to toe Guess by Marciano. For the full listing of what she’s wearing and where to get it, make the jump.

Tinsley Mortimer

Last night we partied hearty with the stars of The City, Elle Creative Director Joe Zee and everyone’s favorite New York City social, Tinsley Mortimer. Held at the GUESS by Marciano store in Soho the event was packed to the walls with a cache of Bravo and MTV reality stars. No Jersey Shorian’s, but give it a week and I’m sure we’ll be seeing a lot more of the tanners at Fashion Week. Scary thought, but true.

Really psyched I got to meet Joe Zee. Major stalker of his tweets so it was definitely a cool opportunity.

Sitting front row at Valencia Fashion Week allowed us to stare down each and every one of the models that walked down the runway.  And one really stood out, Jon Kortajarena.

We later found out that he was Spain’s most famous male model and I instantly recognized him from Tom Ford ads. He’s walked most major runways and stared in campaigns for Guess, Calvin Klein, Tom Ford and many others.

Guess seems to have linked arms with a new partner, Coty Inc. Why do we care? Well, the partnership not only brings Guess further success, but it bring us Guess beauty products! First on the list, a fragrance line. Get ready people!

Gucci is about as tired of Guess as we are. They just filed a complaint in New York against the company that helped make Paris Hilton and Anna Nicole Smith household names. The action is against Guess?’s use of green-and-red stripe designs mixed with interlocking G’s a pattern design the Italian brand claims is theirs. Guess attempting to Guccize sounds scary to me. I guess someone is set to pay for this most heinous act.

I think that Paris Hilton is gorgeous without makeup. I’m sorry, but in many of these photos she looks like a transvestite. I guess that’s what you get when the hair and makeup team work for a Euro-trashy, more is much less kind of brand. This album takes a look at the current ads for spring/summer 2009 as well as some of Hilton’s former campaigns for Guess. I really like the series where she’s standing in front of the wallpaper/curtain; her hair looks gorgeous, she’s not wearing white lipgloss and her skin doesn’t look like last season’s leather bag. I have to give her some props, however, for having a versatile look. Even if sometimes the look is Eurotrash tranny.
