Fisher’s lawyer, Darren Saunders, questioned Fisher over Gucci’s accusations that the defendants undertook a “massive scheme” to knock-off its designs, to which Fisher grew visibly choked up.

“I don’t understand the allegation,” his voice reportedly “quavering.” Accusations such as those, he insisted, would “jeopardize” not only his, but his family’s reputation.

“My family has been making shoes in this country probably longer than Guess exists,” he continued. Fisher’s father founded Nine West in 1978, while Fisher opened his own eponymous company in 2005.

During a three-hour cross-examination, Fisher repeatedly denied that his company knocked off Gucci’s shoes, but merely used them, and other brands, for “reference.”

“We do reference and use vintage designs quite a bit in our industry,” Fisher said, adding that sometimes shoe designs that were allegedly infringed upon Fisher had originally produced years before.

“So, Jimmy Choo knocked you off and then you knocked Jimmy Choo off?” Gucci lawyer Louis Ederer said sarcastically.

Fisher explained that many shoes turned out to be “tremendously similar” particularly over a “50-year period of time.”

Earlier that day, Ederer produced not only a thick binder from the Marc Fisher Footwear library, featuring five years of Gucci shoes Fisher Footwear had used for inspiration, but also a record of Fisher’s Gucci purchases over the last six to seven years, a total of $75,000.

The price tag seemed to shock Judge Shira Scheindlin who responded curiously, “I never saw a $2,000 pair of shoes. What do they look like?”

Ederer explained it was for a dress, not a pair of shoes — probably to the judge’s disappointment — before ending with his final question to Fisher: “You find this case ridiculous, don’t you Mr. Fisher?”

What is this, an episode of The Practice, or whatever legal show the kids are watching these days?

“I don’t think anything that takes this much time and money out of my life is ridiculous,” Fisher replied. “Gucci should have written me a [cease-and-desist] letter. That’s what should have happened.” [WWD, sub req'd]

Gucci claims Guess and its footwear licensee Marc Fisher Footwear has been knocking off its logo and designs for years and is seeking $221 million in damages. Louis Ederer, lawyer for the Italian luxury giant, barraged Marciano with questions and referenced emails dating back to 1995  between Guess buyers and Marc Fisher employees. He also brought up a history of cease and desist letters from Coach, Yves Saint Laurent, Jimmy Choo and Adidas claiming Marc Fisher was knocking off their designs.

Through it all Marciano insisted that Guess simply took inspiration from different brands, including Gucci, for its logos, patterns and designs. When Ederer brought up emails from Marc Fisher indicating that the company was sending Gucci fabric samples to Guess fabric suppliers, Marciano claimed he had no knowledge of the correspondence. However, upon seeing the similarities between Guess and Gucci sneakers, he was “embarrassed.”

Ederer blasted Guess for not following up with Marc Fisher about the shoes saying, “The truth is that Guess has been knocking off Gucci for years.” To which Marciano responded, “No…fashion is about trend, mood and inspiration. You interpret your own way with your own brand.”

To illustrate his point, Marciano referenced the courtroom’s carpeting and claimed that his design team would reinterpret it and throw it on a handbag, to some mild courtroom chuckling.

After Ederer finished badgering the witness, Guess’ lawyer Daniel Petrocelli took over, asking Marciano to describe the company’s relationship with Gucci. Marciano insisted they never had any problems till a cease and desist letter in 2007 and that “if this is something Gucci was genuinely concerned with, they would have acted within days, everywhere,” instead of twiddling their thumbs since 1995. - Brittany Murphy‘s mother is claiming her daughter and son-in-law Simon Monjack were killed by toxic mold found in their Hollywood home. The mold apparently caused the pneumonia that killed both Murphy and Monjack and now Momma Murphy is taking legal action against her lawyers for mishandling her case against the construction company back in January. Jimmy Choo’s third NYC outpost opened this morning in the West Village between Zadig + Voltaire and Marc by Marc Jacobs.   Bedecked with chandeliers, mirrored furniture, and overstuffed seating, the designer shoe brand’s founder Tamara Mellon told Women’s Wear Daily that the shop “evokes the feeling of a Forties boudoir“.  The boutique carries the full range of Choos for women, as well as bags, leather goods, sunglasses, and the Choo 24:7 line, giving downtown fashionistas another place to exercise their credit cards.

- Gianfranco Ferré's new owner, Paris Group, has given the label's creative directors, Tommaso Aquilano and Roberto Rimondi the proverbial boot, citing sluggish sales. A retailer admitted they bought " a minimal amount of the collection for the sake of carrying the brand" but noted that "[t]here was almost no daywear and eveningwear was fairy tale, like something for the Oscars. It may work for a small, niche brand, but not for such a global brand.” Ferré is expected to skip a season until Paris Group  finds it bearings, though those bearings could also be found in the John Galliano label, which the Group may consider purchasing from LVMH. - I guess the Choo is on the other foot…. TowerBrook Capital, the company that owns Jimmy Choo – the shoe not the man — invited a shortlist of three investors and Jimmy Choo — the man not the shoe — was not among them. LVMH is a potential buyer for the brand which TowerBrook is expected to sell for about $653 to $817 million, more than twice what it paid for. I guess there won’t be an old Jimmy who lived in his Choo. Too much? [Elle UK]

- The first round of the CFDA’s Fashion & Friends for Japan auction has raised over $180,000 for relief efforts and now round two is up and running. Through charitybuzz.com, you can bid on, among other things: meeting Anna Wintour and attending a Vogue photoshoot, designing a custom PS1 bag with Jack and Lazaro and  a week-long stay at Diane Von Furstenberg‘s summer house. Look One began with a washed silk jumpsuit. With a solid boned bodice, the heart shaped neckline hugs sturdily on the ribs. This allows the swishy washed silk to sway to the billowing harem whilst staying put on top. The pockets are deep and the ankles are stretchy; Australian duo Zimmerman has paid attention to the details.

The Recycled Net Top: Camilla Norrback, $188

This next piece came into play because of its netted quality that sees clear through to the jumpsuit. As playful as it is practical in the practice of layering, this shirt also happens to very conscious of the world around it. Swedish designer Camilla Norrback can claim eco-friendliness since 2002, and has made this top out of 100% recycled polyester.

The Orchid Statement: Marie-lise Lachapelle $375

Pinned to my hair is an orchid dipped in gold, the flower immortalized as jewelry, preserving its natural beauty. This piece originally sat as a necklace in the display, but with a thick, long curved bobby pin, it became a hairpiece rather simply. With an entrepreneurial sculptor father and high fashion model artist mother, Montreal native Marie-Lise Lachapelle captured the attention of her own celebrity clients with her stunningly delicate jewelry. She made the jump from styling to full time jewelry making in 2005.

The Mary Janes: Pedro Garcia, $180

Just about the only thing that could compliment the flower in my hair is Mary Jane. And this pair by Pedro Garcia elevates the look with a touch of demure formality. Hailing from the south of Spain, the brand breathes the Mediterranean Sea.

I actually don’t hate this look, but Olivia has it all wrong. The fit isn’t perfect, so she looks really boxy in this structured dress. Also, the hair is awful, so that takes away a lot from the look. A cool dress worn in an average manner makes for a mediocre look.

You were a professional ballroom dancer and designed costumes for So You Think You Can Dance. How was that amazing experience? What influenced you to go from dancer to designer?
It was a lot of fun but a lot of work. They don’t tell you which dancers need costumes until Friday afternoon, and they need to be in L.A. by Saturday morning. I did it the first season and realized it’s a little too hectic for me. But now I can say my clothes were on national network TV, so it’s still very exciting.

Ballroom dance costumes cost about $3,000 for one gown, and you cannot wash or dry-clean them. When I danced, I found it strange that people would pay that much money for something you can’t wash. So I started making my own and selling them at a slightly cheaper price point. There is a lot of demand for dresses, but not everybody has the budget to pay thousands of dollars. People always want nice clothes at reasonable prices, and that philosophy carried to my retail stores too.

How did you go from costume designer to store owner?
I used to make clothes and started the line Virketyne. I was going from store to store selling, and this amazing opportunity emerged on the Lower East Side. I said ‘you know what, I’m going to try my hand at selling my stuff and other people’s things,’ and it turns out I’m really good at it. And I enjoy selling! Now I get to call people and tell them I have the space to showcase their lines. It’s much nicer to be on this side of the table.

Do you think your background in costume design influenced how you designed regular clothing? How about the garments you bring into AvaMaria?
Absolutely. Because of all the dancing, I have a weakness for shiny things. Right now, the clothing in the store is very subdued, but if you come at the height of spring or after Thanksgiving, it’s mostly party dresses on the racks. We all need clothes to wear every day, but we also need fun clothes to add that fantasy element and make us feel special. Wanting clothes you can move in is also a big thing from being a dancer. There are clothes that look very nice, but if you don’t feel comfortable, you’re not going to look very good in them.

What do you look for when bringing in an independent designer to AvaMaria?
What is special about the garment and quality of the handiwork is very important. If your design is great, I can work with you season after season, but you need to provide me with good, quality garments. I can’t have customers come back after six months and say there is something wrong with a product they purchased here. Construction is very important. I love working with designers who make their garments here in New York because it helps the local economy and makes re-ordering simpler in the long run.

Aside from local designers, you have a fabulous selection of designer shoes at discounted prices. What made you want to sell this kind of merchandise in the store?
I think New Yorkers are very good shoppers, and everybody loves a good bargain. People get confused when they come into the store and see the shoes – they wonder if they’re second-hand. They ask ‘why are the shoes in such good condition?’ Because they are new! They may be Jimmy Choos from last season, but most women who purchase Jimmy Choos will wear them for more than three months.

I find a thrill in looking for these bargains and feel really happy when I see people find them here. It’s a little bit like playing Cinderella because we almost never have a full size range [in the store]. It’s very exciting when a match is made. AvaMaria is in SoHo, the shopping capital of the world. I need to keep up with all of the competition around me, so finding these designer discounts in very important.

You said that as consumers, we want “limited production quantity, moderate prices, good quality and great style.” Did this philosophy spark the inspiration for your business?
That is how I’ve always wanted to shop and I think there are a lot of people who want to shop this way and don’t have time to dig at Century 21. We provide much better customer service, a friendly atmosphere and a good selection of merchandise. We’re small enough that we can provide intimate customer service you won’t find at large discount stores. That is what boutiques are about, the importance of staff-client relations.

A lot of the time, customers ask for custom sizes or colors. That’s the good thing about working with local designers – it’s much easier to fulfill these requests. If something sold really well, you ask if the garment can be put back into production. Many times, tailoring is included with the price of the garment. I can give the designers feedback, like what sizes people have been asking for, and it’s beneficial to them too. Some designers need a few seasons to improve their craft, so I won’t drop them based on numbers. They need time, and a chance, to evolve.  This is all worth it when the customer keeps coming back for a specific collection season after season.

My best dressed choice was tied between three different beautiful ladies, but Anne Hathaway stands just a bit above the other two in Armani Privé. For a tall beauty with perfect curves like this, a structured shoulder is the best thing you can do for your body. She looks so graceful and statuesque in these beautiful rose sequins.

The back is to die for. It’s provocative, feminine and lovely. Anyone else, I would have said the hair should be worn up, but there is absolutely nothing wrong with the way Anne looks. She is a goddess. She gets an A+.

Green was the color of the night, and no one wore it better than Angelina Jolie in Versace. Again, we’re seeing a beautiful padded shoulder that opens up the back and draws attention to her tiny waist. She looks glamorous without that “going to prom” nod that so many celebrities decided to do. I love the top to bottom sparkles and her elegant and unfussy hair. Grade A.

If you have a flat chest, a 1920s style dress like this is prefect for your body. Jayma Mays got it right in this elegant and sexy Alberta Ferretti plunging v-neck gown. The accessories and curly locks perfectly complete the look. The lipstick looks a little orange, but it works against her hair and skin tones. A-

Now let’s talk about a big chest. Scarlet Johansson has a gorgeous, very voluptuous rack, and this dress enhances in a different way. Instead of spilling her cleavage all over the red carpet, Scarjo chose this demure and elegant Elie Saab gown in a lovely dusty pink. It sparkles just the right amount, and the sleeve is extremely flattering. Plus, she had the best hair on the red carpet. A-

I commend Leighton Meester for trying to take fashion risks, but lately they’ve been backfiring hardcore. I was pleased to see her looking so elegant and sophisticated in Burberry Prorsum on the red carpet last night. Her makeup is absolutely gorgeous and those Jimmy Choo shoes are fab-o-rama. It’s not my favorite, but I do love the dress and her. B

I’m not used to putting Eva Longoria in the best dressed category for her red carpet looks, but she looked ravishing last night in a fitted, black Zac Posen gown. Here is the thing about Lea Michele‘s Oscar de la Renta gown: It does not photograph well. When watching her on the red carpet, she looked young, fresh and vibrant in this light salmon dress. The only one that isn’t completely trashy and “Long Island Princess”-ish is the Siobhan, a Donegal Cable knit cashmere blend boot detailed with antique nickel studs, lamb suede fringe detailed with antique nickel double faced studs.

Jimmy Choo founder Tamara Mellon takes readers on a tour of her home on Manhattan’s Upper East Side, a mix of high art and glam minimalism, and poses with her daughter, Minty. In the interview in the September issue of Harper’s Bazaar, she opens up about her lifestyle, overcoming challenges, and building the Jimmy Choo empire.

On her new life in New York:
“Last year was the best and worst year of my life, a breakthrough year for me,” Mellon explains. “I’ve moved here and managed to clear up a lot of the wreckage. I feel like I’ve arrived in New York with a clean slate, and I have a whole new set of challenges ahead of me. And I find that invigorating.”

On building the Jimmy Choo empire: 
“I’ve paid my dues in this business,” she says. She started working when she was 18 at the London fashion emporium Browns. “At the time, I thought, ‘Why am I doing this? I hate this!’ But the lesson I learned was so valuable: I learned retail.” She later met Jimmy Choo, a London cobbler, and the rest is a fashion fairy tale. “But still, when someone asks about a career in fashion, I say start at the bottom,” she says. “If you want to start a business, you have to know it from the ground up.”

Aren’t they beautiful…..that Tamara Mellon is creating “hit” after “hit!” The lucite heel and Rhinestone ankle cuff are certainly stunning accents. Better still, is the neutral color which allows for wear with a variety of looks. The Christian Dior is another standout neutral. Fringe, stitching and the onyx colored stones are a perfect mix, making them funky and fabulous! It’s apparent that Versace enjoyed a great deal of success with their patterned and print shoes from last season. I like the idea of a bold shoe, not only to wear with solids, but to mix with a patterned or print dress or top.

Today’s cocktail dress has evolved into a “magical” thing of beauty. Not to take anything away from the, “legendary” little black dress, but today’s offerings are so vast that one is hard pressed to choose just one. Before making the final purchase, if you’re like me, you want to check ALL of the stores for fear of missing out that perfect little number.

Versatility is key, as I personally prefer a dress that can be worn with a variety of shoe styles as well as colors. When in search of “that shoe,” a metallic gold or silver will usually fit the bill. Of course black is a must, but I also love to add a colorful, “entrance-making” shoe or bag. The bottom line is, it’s all about the mixing and the matching and personal preference.
