Trovata vs. Forever21 Mistrial featured

So if you like the fashion news publication ApparelNews as I do, then you may already know about Trovata having tried to sue Forever21 for knocking off 6 pieces from his Spring ‘06 collection. In case you don’t, Trovata, a fairly new designer, tried to sue Forever21 for trade dress infringement. This means that Trovata feels that Forever21 has copied something they feel is a unique creation or design of the brand Trovata. As we all know, Forever21 is notorious for knocking off runway trends, but they usually make some major changes, so that anyone who is fashion forward will know the difference right away. Well after close observation of the 2 garments provided in the article by ApparelNews, the resemblance is uncanny. I was thrown off by how much Trovata and Forever21’s garments looked alike, it was pretty bad. However, Trovata’s pieces in question are extremely ordinary, a striped cardigan and striped polo style shirt, there is nothing about these items that says unique. Another important factor is, Trovata is not a well known label, so people aren’t going to look at the copies in a Foreve21 and say, “oh this is a Trovata knockoff”. Even the color palette chosen for the pieces was nothing we haven’t seen before. If anything, someone out there should be suing Trovata, but it would be harder than figuring out the Da Vinci code, than to try to figure out who originally created the striped cardigan and polo, not even Ron Howard could make a movie long enough to capture all those boring details, lol. I can understand why the judge declared a mistrial after the jury was unable to come to a decision. This is why I leave you fashion junkies to make the decision for yourself.
